Title says it all pretty much, I am using R5 Mark 2
I set the "AF-assist beam firing" to Disabled.
I am uisng MF
When I use the camera all is fine, the "AF-assist beam firing" does not fire
When I use then BR-E1 the"AF-assist beam" flashes red anyway, I had to stop using the BR-E1

To me this sounds like the self-timer is set when you are using the BR-E1. The AF assist lamp on the camera body is also used to indicate when the self-timer is counting down. If you change the drive mode to single shooting with the BR-E1 does it stop the light from flashing? Unlike older cameras that used an infrared remote, the EOS R5 Mark II does not need to have the drive mode set to a self-timer mode to be able to use the BR-E1.

I alredy ruled that out.
Driver mode was set set to single shot.

On the side of the BR-E1 there is a three position slide switch, the top position is immediate release, the middle position is 2-second timer release and the lower one is movie recording start / stop. It sounds like you have the switch in the 2-seconds timer release position.
Here's a screen grab of the BR-E1 manual page.

No switch is set to "Immediate release"

I tired with "2-sec. delay release" AND in that case the AF beam does not fire.
No AF beam when using the smartphone, that works as expected.
AF beam fires with "Immediate release" using BR-E1

I contacted my region Canon support.
In the meantime it would be cool if someone could do a test and confirm or deny the bug.

I received reply form my region Canon support and they say that per design the BR-E1 ignores the option and will always use the "AF-assist beam firing".
I was told to "mask" the red led light to deal with it i.e. put tape on it.
This is nonsense for me.
I would like to hear form Canon on this terrible design decision:
